This post is a file-based reconstruction. Private family members and the child are not named. Public names appear only for verified professional or judicial roles. LawReport separates documented procedural acts, party submissions, judicial findings and editorial analysis.

What the files show

On 30 March 2026, Judge Jolanda Genton stated in a letter from the District Court of Wil that only maintenance applications had been filed in the precautionary proceedings in question and that a decision was to be made on those. At the same time, the next written decisions were announced.

On 10 June 2026 Genton confirmed that the maintenance decision was still pending, but at the same time opened an additional round of submissions regarding Beistandschaft, psychological assessment or support, a parenting course and a possible preliminary child protection decision.

On 15 June 2026 the father requested, prior to a substantive consideration of additional child protection issues, a formal procedural clarification. That such a clarification was requested is documented; the allegation that its handling was legally insufficient remains a procedural objection and not a violation of law already determined by a court.

Why this is legally delicate

Procedural boundaries are not a formality. They determine what a party must respond to, which facts are relevant to the decision, which remedy is available and which time limits apply. If the subject matter changes, the affected party must be able to recognise exactly what is to be decided. This is all the more true where the party is not legally represented and financial as well as child protection law issues are simultaneously at stake.

What does not automatically follow from that

From the documented chronology neither misconduct by a named person nor a violation by the court automatically follows. Where the records contain only a party’s allegation or objection, it is described as such. Where a court has expressly found something, that finding may be stated clearly.

The role of professional participants

With lawyer Raphael Fisch, these posts concern documented legal submissions and motions, not an allegation of personal motives. With Judge Jolanda Genton, they concern documented court communications and procedural steps, not a blanket assessment of her as a person. The Kreisgericht Wil is linked as an institution to the actions substantiated in each case.

LawReport-Classification

The journalistic sharpening therefore lies in the juxtaposition of verifiable documentary points. Readers should be able to see when an allegation has merely been made, when evidence exists, when a court has established something, and when a legal question is still open. It is precisely this separation that makes sharp reporting more robust than personal attacks.
