This article is a record-based reconstruction. Private family members and the child are not named. Public names appear only for verified professional or judicial roles. LawReport separates documented procedural actions, parties’ submissions, judicial findings and editorial analysis.
What the files show
On 14 July 2026, attorney Raphael Fisch applied on behalf of his client for precautionary child protection measures, a visitation-rights guardianship and a court authorization for psychological assessment and/or support. Nine enclosures were submitted.
The holiday documents show a real conflict over the timing and binding nature of holiday weeks. Such a conflict can be relevant for case management; however, it is not automatically equivalent to an endangerment of the child’s welfare or to proof that a Beistandschaft or a psychological assessment is required.
The representation put forward by the opposing party regarding Fisch — that reliable communication and cooperation do not take place — was disputed by the father. As counter-evidence, he submitted messages that document specific arrangements concerning school mail, a doctor's appointment, a vaccination, hearing and vision tests, as well as kindergarten. That does not prove a conflict-free relationship, but it tempers a blanket assertion of total inability to cooperate.
Why this is legally sensitive
Child protection can be swift and intrusive; precisely for that reason it requires a clearly specified factual basis. A guardianship or psychological assessment may be appropriate or necessary in individual cases; their necessity does not, however, follow automatically from a parental conflict alone. What is decisive are concrete, verifiable indications, proportionality, and a clear separation between assistance, assessment and sanction.
What does not automatically follow from that
The documented chronology does not automatically imply misconduct by a named person or a violation by the court. Where the files contain only a party’s allegation or objection, it is identified as such. Where a court has expressly found something, that finding may be stated explicitly.
The role of the professional participants
In the contributions concerning attorney Raphael Fisch, these deal with documented legal submissions and motions, not with an attribution of personal motives. With regard to Judge Jolanda Genton, they concern documented court writings and procedural steps, not a blanket assessment of her person. The Kreisgericht Wil is linked as an institution to the actions substantiated in each case.
LawReport classification
The journalistic sharpening therefore lies in the juxtaposition of verifiable points from the files. Readers should be able to see when an allegation has merely been made, when evidence exists, when a court has found something, and when a legal question is still open. It is precisely this distinction that makes pointed reporting more robust than personal attacks.
