This entry is a case-file reconstruction. Private family members and the child are not named. Public names appear only for verified professional or judicial roles. LawReport separates documented procedural acts, party submissions, judicial findings and editorial analysis.

What the files show

The holiday documents show a real conflict over the timing and binding nature of holiday weeks. Such a conflict may be relevant to case management; it is not, however, automatically equivalent to an endangerment of the child’s welfare or to proof that a Beistandschaft or a psychological assessment is required.

The account put forward by the opposing party via Fisch that reliable communication and cooperation do not take place was denied by the father. As counter-evidence he submitted messages documenting concrete arrangements regarding school mail, a doctor's appointment, vaccination, hearing and vision tests, and kindergarten. That does not prove a conflict-free relationship, but it qualifies a blanket assertion of complete inability to cooperate.

On 14 July 2026, attorney Raphael Fisch applied on behalf of his client for precautionary child protection measures, a visitation-rights legal representative (Besuchsrechtsbeistandschaft) and a court authorisation for psychological assessment and/or support. Nine annexes were submitted in this connection.

On 10 June 2026 Genton confirmed that the maintenance decision was still pending, but at the same time opened an additional round of submissions concerning Beistandschaft (custodial assistance), psychological assessment or support, a parenting course and a possible preliminary child protection decision.

Why this is legally sensitive

Child protection can be swift and intrusive; precisely for that reason it requires a clearly specified factual basis. A custodianship or psychological assessment can be appropriate or necessary in an individual case; however, their necessity does not automatically follow from a parental conflict alone. What matters are concrete, verifiable indications, proportionality and a clear separation between assistance, assessment and sanction.

What does not automatically follow from that

The documented chronology does not automatically imply misconduct by any named person nor a legal violation by the court. Where the files contain only a party’s assertion or objection, it is described as such. Where a court has expressly found something, that finding may be clearly stated.

The role of professional participants

In the case of attorney Raphael Fisch, these posts concern documented legal submissions and motions, not an attribution of personal motives. In the case of Judge Jolanda Genton, they concern documented judicial letters and procedural steps, not a blanket evaluation of her person. The Kreisgericht Wil is linked as an institution to the actions documented in each instance.
