This article is a file-based reconstruction. Private family members and the child are not named. Public names appear only for verified professional or judicial roles. LawReport separates documented procedural actions, party submissions, judicial findings, and editorial analysis.

What the files show

The holiday documents show a real conflict over the timing and binding nature of holiday weeks. Such a conflict can be relevant for case management; however, it is not automatically equivalent to an endangerment of the child’s welfare or proof that a Beistandschaft or psychological assessment is required.

On 14 July 2026, attorney Raphael Fisch, on behalf of his client, applied for precautionary child protection measures, a guardian for visitation rights, and a court authorization for psychological assessment or support. Nine enclosures were submitted in this connection.

Why this is legally sensitive

Child protection can be swift and drastic; precisely for that reason it requires a clearly specified factual basis. A guardianship or psychological assessment can be appropriate or necessary in individual cases; however, their necessity does not automatically follow from a parental conflict alone. What is decisive are concrete, verifiable indications, proportionality and the clear separation between assistance, assessment and sanction.

What does not automatically follow from that

From the documented chronology neither misconduct by a named person nor a violation of the court automatically follows. Where the files contain only a party's allegation or complaint, it is referred to as such. Where a court has expressly determined something, that determination can be explicitly stated.

The role of professional participants

In the posts concerning attorney Raphael Fisch, the focus is on documented legal submissions and motions, not on an imputation of personal motives. In the case of Judge Jolanda Genton, the focus is on documented court documents and procedural steps, not on a general assessment of her person. The Kreisgericht Wil is linked as an institution to the actions evidenced in each case.

LawReport classification

The journalistic edge therefore lies in the juxtaposition of verifiable documentary points. Readers should be able to see when an allegation was merely asserted, when evidence exists, when a court has established something, and when a legal question remains open. It is precisely this separation that makes pointed reporting more robust than personal attacks.
