This entry is a reconstruction based on files. Private family members and the child are not named. Public names appear only for verified professional or judicial roles. LawReport separates documented procedural actions, parties' submissions, judicial findings and editorial analysis.
What the files show
On 30 March 2026, Judge Jolanda Genton stated in a letter from the District Court of Wil that in the provisional proceedings in question only maintenance applications had been filed and that a decision was to be made on them. At the same time, the next written decisions were announced.
On 10 June 2026 Genton confirmed that the maintenance decision was still pending, but at the same time opened an additional round of submissions regarding guardianship, psychological assessment or support, a parenting course and a possible prior child protection decision.
On 15 June 2026 the father requested a formal procedural clarification before a substantive consideration of additional child protection matters. That such a clarification was requested is documented; the assertion that its handling was legally inadequate remains a procedural complaint and not a legally established violation by a court.
On 21 July 2026 Genton served the father with Fisch’s submission together with nine appendices, granted ten days to respond and announced that no further hearing was planned. A decision in writing was to be made on modification of maintenance, child protection measures and an instruction to the debtor.
Why this is legally sensitive
Procedural limits are not a mere formality. They determine what a party must respond to, which facts are relevant to the decision, which remedy is available and which deadlines apply. If the subject matter changes, the affected party must be able to recognise exactly what is to be decided. This is all the more true if they are not legally represented and financial as well as child protection issues are at stake simultaneously.
What does not automatically follow from that
The documented chronology does not automatically imply misconduct by a named person or a legal violation by the court. Where the files contain only an allegation or objection by a party, it is identified as such. Where a court has expressly found something, that finding may be clearly stated.
The role of the professional participants
In the entries concerning attorney Raphael Fisch, the focus is on documented legal submissions and motions, not on ascribing personal motives. In the entries concerning judge Jolanda Genton, the focus is on documented judicial writings and procedural steps, not on a general evaluation of her person. The District Court of Wil is linked to the actions documented in each case as an institution.
