This contribution is a case-file-based reconstruction. Private family members and the child are not named. Public names appear only for verified professional or judicial roles. LawReport separates documented procedural actions, party submissions, judicial findings and editorial analysis.

What the files show

One of the submitted daycare documents contained the striking remark «Keine Abholung durch Vater!!». The files also show the opposing position that this private contractual notation alone does not establish either a mutual parental agreement or a judicial or administrative restriction of contact or pick-up rights.

According to the file index, the attachment package included, among other things, insurance documents, family allowances, daycare contract and rates, daycare invoices, holiday correspondence, as well as a payroll statement. None of the nine attachments was designated as a professional psychological, child psychiatric, or official assessment.

Why this is legally sensitive

The crux is the evidentiary threshold: an allegation can trigger a procedural step, but that does not make it true. There are legally significant differences between a party’s submissions, a fact rendered credible, an expert assessment and a judicial finding. Anyone who mixes these levels gives the public a distorted picture and can in practice impose on an affected person a burden of proof that the procedure does not provide for.

What does not automatically follow from that

From the documented chronology no misconduct by a named person nor any legal violation by the court automatically follows. Where the case files contain only a party’s allegation or objection, it is identified as such. Where a court has expressly found something, that finding may be stated clearly.

The role of the professional participants

In these posts concerning attorney Raphael Fisch, the focus is on documented legal submissions and motions, not on imputing personal motives. Concerning Judge Jolanda Genton, the focus is on documented court documents and procedural steps, not on a blanket assessment of her person. The District Court of Wil is referenced as an institution linked to the specific actions documented.

LawReport classification

The journalistic sharpening therefore lies in the juxtaposition of verifiable file points. Readers should be able to see when an allegation has merely been made, when evidence exists, when a court has found something, and when a legal question remains open. It is precisely this separation that makes pointed reporting more robust than personal attacks.
