This article is a file-based reconstruction. Private family members and the child are not named. Public names appear only for verified professional or judicial roles. LawReport separates documented procedural actions, party submissions, judicial findings and editorial analysis.
What the files show
On 14 July 2026, attorney Raphael Fisch applied on behalf of his client for precautionary child protection measures, a visitation-rights guardianship and judicial consent to psychological assessment or support. Nine attachments were submitted.
The attachment package included, according to the file index, among other items insurance documents, family allowances, daycare contract and rates, daycare invoices, holiday correspondence, as well as a payslip. None of the nine attachments was designated as a specialist psychological, child psychiatric or administrative assessment.
Why this is legally sensitive
Child protection can be swift and intrusive; precisely for that reason it requires a clearly specified factual basis. A Beistandschaft or psychological assessment may be appropriate or necessary in individual cases; their necessity does not, however, automatically follow from a parental conflict alone. What is decisive are concrete, verifiable indications, proportionality, and a clear separation between assistance, assessment and sanction.
What does not automatically follow from that
The documented chronology does not automatically imply misconduct by any named person nor a violation of the court. Where the files contain only a party’s allegation or objection, it is identified as such. Where a court has expressly determined something, that finding may be clearly stated.
The role of the professional participants
In the posts concerning attorney Raphael Fisch, the focus is on documented legal submissions and motions, not on imputing personal motives. In the case of Judge Jolanda Genton, the focus is on documented court writings and procedural steps, not on a general assessment of her person. The District Court of Wil is linked as an institution to the actions substantiated in each case.
LawReport classification
The journalistic sharpening therefore consists in the juxtaposition of verifiable points from the files. Readers should be able to tell when an allegation has merely been made, when evidence exists, when a court has found something, and when a legal question is still open. It is precisely this distinction that makes incisive reporting more robust than personal attacks.
