This entry is a file-based reconstruction. Private family members and the child are not named. Public names appear only for verified professional or judicial roles. LawReport separates documented procedural acts, party submissions, judicial findings and editorial analysis.
What the files show
The file register shows an application for debtor instruction filed by attorney Raphael Fisch on 14 October 2025. The submission asserted that the requirements for a direct instruction to employers or social insurance carriers were met; the father objected and referred to his current ability to pay as well as the concurrently pending modification proceedings.
The files document repeated submissions by the father in which he pointed to a lack of or severely reduced income, ongoing or imminent enforcement measures and a pending maintenance decision. These submissions substantiate the claimed urgency; whether a delay in the administration of justice results from this must be assessed separately under the law.
Why this is legally sensitive
In maintenance and enforcement, time has an immediate effect. A later decision cannot undo an earlier debt collection, seizure, or liquidity crisis. That does not mean that every prolonged duration of proceedings is unlawful. It does mean, however, that urgency, current ability to pay, and the coordination of parallel proceedings must be taken seriously on the merits when financial consequences have already arisen.
What does not automatically follow from this
The documented chronology does not by itself imply misconduct by any named person nor a violation of the court. Where the files contain only a party’s allegation or objection, it is identified as such. Where a court has expressly found something, that finding may be clearly identified.
The role of the professional participants
In the case of attorney Raphael Fisch, these contributions concern documented legal submissions and motions, not an imputation of personal motives. In the case of Judge Jolanda Genton, they concern documented judicial letters and procedural steps, not a blanket assessment of her as a person. The District Court Wil is linked as an institution to the respective documented actions.
LawReport classification
The journalistic sharpening therefore lies in juxtaposing verifiable documentary points. Readers should be able to discern when an allegation has merely been asserted, when evidence exists, when a court has found something, and when a legal question is still open. It is precisely this distinction that makes pointed reporting more resilient than personal attacks.
