This contribution is a file-based reconstruction. Private family members and the child are not named. Public names appear only for verified professional or judicial roles. LawReport separates documented procedural acts, parties' submissions, judicial findings and editorial analysis.

What the records show

In the same decision the court held that both parents were loving and committed and that both were fully capable of parenting. Individual mistakes or conflicts were likewise not equated with an inability to parent.

On 14 July 2026, attorney Raphael Fisch, on behalf of his client, applied for precautionary child protection measures, a visitation-rights guardianship, and judicial consent to psychological assessment or support. Nine attachments were submitted.

On 10 June 2026 Genton confirmed that the maintenance decision remained pending, but at the same time opened an additional round of submissions regarding Beistandschaft (assistance), psychological assessment or support, a parenting course and a possible preliminary child protection decision.

Why this is legally sensitive

Child protection can be swift and intrusive; precisely for that reason it requires a clearly specified factual basis. A guardianship (Beistandschaft) or psychological assessment may be appropriate or necessary in individual cases; however, their necessity does not automatically follow from a parental conflict alone. Decisive are concrete, verifiable indications, proportionality and a clear separation between assistance, assessment and sanction.

What does not automatically follow from that

Nothing in the documented chronology automatically implies misconduct by a named person or a legal violation by the court. Where the files contain only a party's allegation or objection, it is identified as such. Where a court has expressly found something, that finding may be clearly stated.

The role of the professional parties

In the posts about attorney Raphael Fisch, the focus is on documented legal submissions and motions, not on attributing personal motives. Regarding judge Jolanda Genton, the focus is on documented court letters and procedural steps, not on a blanket assessment of her person. The Wil District Court is linked as an institution to the actions that are substantiated in each case.

LawReport classification

The journalistic sharpening therefore lies in juxtaposing verifiable points from the files. Readers should be able to see when an allegation was merely made, when evidence exists, when a court has established something, and when a legal question remains open. It is precisely this distinction that makes sharp reporting more robust than personal attacks.
