This report is a case-file-based reconstruction. Private family members and the child are not named. Public names appear only for verified professional or judicial roles. LawReport separates documented procedural actions, party submissions, judicial findings and editorial analysis.
What the files show
The official case registers listed divorce, precautionary financial measures and debtor order as separate proceedings. Precisely for that reason, for public classification it is important not to automatically treat them as a single subject-matter merely because of temporal proximity.
On 30 March 2026, Judge Jolanda Genton stated in a letter from the Wil District Court that only maintenance applications had been filed in the precautionary proceedings in question and that these were to be decided. At the same time, the upcoming written decisions were announced.
On 10 June 2026, Genton confirmed that the maintenance decision was still pending, but at the same time opened an additional comment round regarding Beistandschaft, psychological assessment or support, a parenting course and a possible preceding child protection decision.
On 14 July 2026, Attorney Raphael Fisch applied on behalf of his client for precautionary child protection measures, a visitation-rights guardianship (Besuchsrechtsbeistandschaft) and a court authorization for psychological assessment and/or support. Nine enclosures were submitted in this connection.
In the same submission, Fisch had it stated that further allegedly documented incidents should not be disclosed in advance in the proceedings, but only communicated to the KESB in the course of an investigation. This raises the question of how the right to be heard can be ensured with respect to material that is not initially disclosed to an affected party.
On 21 July 2026 Genton served the father with Fisch’s submission together with nine annexes, granted ten days for a response and announced that no further hearing was planned. A written decision was to be made on modification of maintenance, child protection measures and a debtor order.
A previous court decision explicitly held with respect to allegations about the father’s parenting ability that they were unsubstantiated, not supported and not proven. The court described them as mere assertions and not as a professional assessment of parenting ability.
Why this is legally sensitive
Procedural limits are not a mere formality. They determine what a party must respond to, which facts are relevant to the decision, which remedy is available and which deadlines apply. If the subject matter changes, the affected party must be able to recognise what exactly is to be decided. This is all the more true if they are not legally represented and financial as well as child-protection issues are simultaneously at stake.
